Big D:

This has been interesting reading. I urge you not to give up too soon.

It is no wonder that you did not find the 50% rule in the by-laws. I believe if you go back to page 1 of this thread and read the decision of the special committee, they effectively acknowledge that they "created" the 50% rule with their decision.

Paraphrasing, what the decision says is that the by-laws say clubs must "operate" within their districts. Then, they acknowledge that the term "operate" is not defined. Then, they set a two-part definition for "operate".

The special committe obviously believed (whether correctly or not--I don't know for sure) that they had the authority to establish this definition.

The committee decision references the SCYSA "Rules and By-laws" as if they are one thing. This is not exactly correct. There are SCYSA Rules and there are SCYSA By-Laws. I believe (but could be wrong) that there is an important difference between the two. Rules can be changed by the board, at its descretion. By-laws are governed by SC law and (I assume) can only be changed by a vote of the members.

My conclusion is that the committee may have the authority to establish this definition. (without taking a position on whether they should have done so, although I reserve the right to take such a position in the future).

OK, lunch is over...back to work.

Tom,
Are you sure about your non denial denial and triple negatives- I feel like I'm hearing King George talk. The whole "don't give up yet Big D" seems to tip your hand. I feel like I know where you stand.

BD....

What we need to do is create an injuction against Chico for voicing his opinion about Mid district matters. As Chico belongs to the upstate district (regardles of residency) his opinions should not matter. Furthermore BridgeFA is not allowed to comment, as clearly he would be out of the Low Country jurisdiction.

And lastly. we should probably secede from the whole thing, since obviously those CESA people must be northern aggressors, trying to change our way of life.

Tom,
Not sure where you stand politically so I am officially retracting the King George comment. The devil made me do it.

Futbol, great post. Lest we forget- the North did win.

Ricky, I'm ready for J. Edgar to show up with pom poms.

Nasty:

I try to stay neutral to the extent possible.

Sorry about the number of "asides". Just trying to head off people picking apart pieces of the post and missing the larger ideas.

By the way -- did you notice how NECSA complained about coaches being hired and the like and the SCYSA ignored it? Do you want to know why? Because the hiring of coaches at any point in the year is completely legal and protected under SC employment law in the absence of employment contracts -- so creating out of whole cloth a rule about that wasn't possible even though if you note the issue is never mentioned in any SCYSA bylaw, code of ethics, or rule. But let's go further into the "ethical realm" -- the two coaches in the original announcement both resigned and then asked CESA for jobs. How do I know? Because I heard that they both testified, either in written or verbal form, to the SCYSA to just that fact.

In addition, CESA never advertised in local papers.

Bottom line: Wow! What grounds for an appeal/grievance (if an appeal or grievance is possible.)

Just to clear up one point. Chris Christian resigned AFTER the CESA announcement and never before hand. As team manager I have the dated resignation. Eddie did resign first. I know this doesn't make any difference. Chico always likes the facts exactly right so I wanted to make sure that is clear, because I wouldn't want anyone accusing him of being one sided in his facts.
